Supreme Court Judge Stephen Breyer has notified the White House that he will officially retire Thursday at noon. His retirement, which Breyer first announced was imminent in January, will come after the country’s highest court dictated its final opinions before taking the summer holidays. After his retirement is made official on Thursday, Breyer will be present while, minutes later, Judge Ketanji Brown Jackson is sworn in as the first black judge in court. Jackson, 51, was confirmed to the seat in April. She is “ready to take the oaths prescribed to begin her service as the 116th member of this Court,” Breyer wrote in his note Wednesday to President Joe Biden. Breyer, 83, has been a member of the Supreme Court since 1994. Under the statute cited in his letter, he will be allowed to retain his title, hold office in court and continue to receive a salary.
