The American Civil Liberties Union of Arizona and the Center for Reproductive Rights filed an emergency motion Saturday in an effort to block the state’s 2021 “personality” law that they say could be used to ban all abortions in Arizona.

Arizona has two abortion laws, one more than 100 years old that bans all abortions and another signed earlier this year that bans the procedure after 15 weeks with exceptions for cases to save the mother’s life .
Saturday’s motion challenges a 2021 law banning requested abortions because an unborn child has a genetic abnormality to survive. This law makes it a crime for a doctor to terminate a pregnancy due to a genetic abnormality. The legislation also includes a “personality” provision.

A U.S. district judge blocked part of the genetic abnormalities law last year, but chose not to suspend the “personality” provision. The provision states that the state will interpret all laws to grant civil rights to unborn children.
The ACLU and the Center for Reproductive Rights claim that the “personality” provision subjects medical providers and pregnant women to possible prosecutions, saying providers could be charged under various laws, including endangering or harassing them. ‘child aggression.
The Center for Arizona Policy, a conservative nonprofit pressure group, said Saturday that the state Legislature passed the law to state that unborn children have full rights if Roe v. Wade reverses.

“The overthrow of Roe allows states to enact abortion laws,” said group president Cathi Herrod. “Arizona established this law to say that unborn children are protected by law.”
Herrod said he expects more challenges to Arizona abortion laws.
The case, which was filed on behalf of two abortion providers, argues that the “personality” law is too vague.
The law states that civil and criminal laws must guarantee the rights of fertilized human fetuses, embryos and eggs at any stage of development. According to the motion, the law does not provide guidance for applying it to the care of abortion.
Statewide abortion providers were forced to suspend proceedings following the Supreme Court ruling on Friday 5-4.
