A portion of the 25th Amendment, which addresses presidential succession, allows a vice president and a majority of the cabinet to vote to remove a president from office due to his inability to “exercise the powers and duties of his office.”
Pompeo served as CIA director during the first year of Trump’s presidency and led the State Department during Trump’s last three years, where he was a staunch Trump ally and supporter.
The committee declined to comment. The New York Times first reported Pompeo’s expected appearance on Tuesday. As discussions focus on the 25th Amendment, the committee is also expected to hear from Doug Mastriano, a Trump-endorsed Republican candidate for governor in Pennsylvania who is also expected to appear earlier. Mastriano, a key figure in Trump’s effort to overturn the 2020 election, led a mock legislative “hearing” at a hotel in Gettysburg just weeks after the 2020 election, where Trump and his then-lawyer Rudy Giuliani made false claims about voter fraud. Several Trump cabinet officials have already met with the committee, including acting Defense Secretary Chris Miller, acting Attorney General Jeffrey Rosen and Labor Secretary Eugene Scalia. Attorney General William Barr also met with the committee, but had left the administration before the January 6 uprising.
