A crucial step is being taken to resolve quarterback Deshaun Watson’s player status for the 2022 season. A disciplinary hearing began Tuesday to determine whether Watson violated the NFL’s personal conduct policy.
Watson had faced 24 civil lawsuits alleging inappropriate sexual conduct during massage sessions that took place while he was with the Houston Texans. Twenty of the 24 cases were resolved last week. Two grand jurors in Texas refused to file criminal charges against Watson, who has denied any crime, earlier this year.
Retired U.S. District Court Judge Sue L. Robinson, who was jointly appointed by the NFL and NFLPA, is leading the hearing. The procedure is expected to take several days.
By procedure, the NFL had to inform Robinson, Watson and the NFLPA of their recommended discipline at least 10 days before the hearing, according to the NFL collective agreement. There are several NFL reports seeking an indefinite suspension that will last at least a year. Talks between the NFL and the NFLPA / Watson before the hearing did not reach an agreement.
There is no set schedule for Robinson to issue a sentence. Ideally it would be a decision before the Browns open the training camp on July 27th. The final resolution of the case would be a conclusion of non-violation of the policy, which does not seem likely.
Both parties have three business days to file an appeal if discipline is imposed. Commissioner Roger Goodell or someone designated as his designated seat would preside over the appeal, with the freedom to increase, decrease, or affirm Robinson’s punishment.
Signature of confiscation bonus / cancellation of guarantees
Whether Watson receives a one-year suspension or is allowed to play football this season, the $ 44.965 million signing bonus on the $ 230 million fully guaranteed five-year contract he signed in March as part of its trade with jeans is not in jeopardy because of the way the contract is structured. Watson’s salary guarantees will not be void under any circumstances.
It is because of the specific language of Watson’s contract. The relevant language on the signature bonus is as follows.
“… a suspension by the NFL solely in connection with matters communicated to the Club in writing pursuant to paragraph 42 which entails the player’s unavailability for the Club only for games during the 2022 NFL League Years or 2023 will not subject the player to the loss of the signing bonus. “
Without that language, the Browns would be entitled to ask Watson for the $ 8.993 million signing premium attributed to the 2022 salary cap with a one-year suspension. It would have been an eighteenth of the $ 8.993 million signing bonus attributed to the 2022 salary cap for each week of the 18-week regular season that Watson lost with a shorter suspension. For example, an eight-game suspension would have given the Browns a chance to recover $ 3,996,889 (or eight-eighths of $ 8.993 million) from Watson.
Technically, Watson has not received any of his signing bonuses. Fifteen million will be paid on July 31st. Another $ 15 million is due on January 31 and the final $ 14.965 million will be paid on March 31. Salary deferrals do not affect the exemption.
The suspensions are unpaid, but that corresponds to the base salary. Because Watson’s base salary in 2022 is $ 1.035 billion, he will lose $ 57,500 (or one-eighth of the $ 1.035 million) for each week he has lost due to a suspension.
The relevant language that prevents Watson’s warranties from being void is set out below.
“… shall not constitute a foul or refusal to practice or play with the Club and the player shall not be in arrears if: … (iii) The player is suspended solely in connection with matters communicated to the Club in writing in agreement with paragraph .42, which makes the player unavailable to the Club only for games during the 2022 or 2023 NFL League years. “
The language is significant because it prevents the Browns from leaving the contract without massive limit consequences due to the bad behavior that was known before the exchange. Presumably, any additional allegations related to the massage sessions while Watson was with the jeans would not qualify as new misconduct.
In other words, the Browns can’t get out of the deal because of the accusations stemming from the massages. Practically speaking, the Browns would not do so even if it was possible after giving up the 2022, 2023 and 2024 first round elections, a 2022 fourth round selection, a 2023 third round selection and a fourth round selection of the 2024. Watson and a 2024 sixth-round pick.
These limitations correspond to the first two years of the contract. If any discipline in these matters occurs after 2023, the Browns will have the right to request a refund of the bonus money to Watson and / or void the remaining warranties of the contract.

Consequences of a one-year suspension
The biggest ramification of a one-year suspension is that Watson’s contract currently in effect until 2026 will charge. Essentially, Watson’s contract would be frozen and resumed in 2023 with a toll. This means that your 2022 contract year would become your 2023 contract year and the additional years of the contract would also be delayed by one year. Instead of Watson’s contract expiring after the 2026 season, it would end after the 2027 season.
Although the contract would be delayed for a year, the apportionment of the $ 8.993 million annual signing bonus from 2022 to 2026 would remain intact. Watson’s maximum salary figure for 2022 is $ 10.028 billion, which is $ 8.993 million in wage apportionment and its base salary of $ 1.035 billion. That base salary would come out of Cleveland’s books for $ 1.035 million relief from the 2022 cap.

Branches of a shorter suspension
Another important ramification of a one-year suspension would be Watson’s banishment from the training camp. That wouldn’t be the case with a suspension that would allow him to play football in 2022. Watson would be allowed to fully participate in training camp and play in the Browns preseason games. The suspension would not take effect until Sept. 5, which is the day after the preseason training camps as defined by the ABC end.
Watson’s contract has no effect with a suspension where he can play football in 2022. His contract years will last as planned, meaning his deal would end after the 2026 season. Watson would lose any base salary that it was not won due to the suspension. For example, an eight-game suspension would cost Watson $ 460,000 (or eight-eighths of the $ 1,035 million) as he earns $ 57,500 each of the 18 weeks of the regular season.
Watson could return to team facilities and participate in limited activities during the second half of a suspension. The activities allowed would be virtually the same as players who are suspended under the NFL’s substance abuse and performance improvement policies.
Most importantly, Watson could attend team meetings, train individually with the Browns strength and conditioning coach, meet individually with the Browns head coach Kevin Stefanski, offensive coordinator Alex Van Pelt and quarterbacks coach Drew Petzing, and receive treatment / rehabilitation from The Browns medical staff and coaches after the fourth game of an eight-game sanction. Prohibited activities throughout the suspension include attending, observing or participating in training, attending home or away matches, and attending or participating in group training.
