The FDA will order Juul e-cigarettes out of the US market

The Food and Drug Administration is preparing an order for Juul Labs Inc. withdraw your e-cigarettes from the US market, according to people familiar with the matter.

The FDA could announce its decision as soon as Wednesday, people said. The marketing refusal order would follow a nearly two-year review of the data submitted by the vaping company, which applied for authorization for its tobacco and menthol-flavored products to remain on the U.S. market.

Uncertainty has clouded Juul since he landed in the FDA’s sights four years ago, when his fruity flavors and hip marketing were blamed for fueling an increase in vaporization of minors. The company has since been trying to regain the trust of regulators and the public. It limited its marketing and in 2019 stopped selling sweet and fruity flavors. Juul’s sales have fallen in recent years.

The FDA has banned the sale of all sweet and fruity e-cigarette cartridges. The agency has paved the way for Juul’s main rivals, Reynolds American Inc. and NJOY Holdings Inc., to keep tobacco-flavored e-cigarettes on the market. Industry observers expected Juul to receive a similar authorization.

Juul did not comment immediately. The company could file an appeal through the FDA, challenge the decision in court, or file a revised application for its products.
